Terms and Conditions

1. DEPOSIT/BOOKINGS
To secure your order and booking date, an initial deposit/retainer of 50% is required, this reserves your event date and is non-refundable (unless COVID LOCKDOWN mandates apply- please refer to Section 2 of our terms and conditions). The agreed quoted price is only valid for 7 days from date issued, and does not automatically mean your cake is booked in until your deposit is received. If your booking is less than 8 days from collection date, the full amount is required at the time of booking. GST is calculated into your price and will appear on your invoice.

2. CANCELLATIONS
If the circumstances arises and you need to cancel your cake order for any reason (outside of a COVID lockdown), please contact Be Caked in writing via email (info@becaked.com.au) as soon possible. The more notice you can give, the more chance we have of being able to help.

a) We can transfer the money paid for your order to a new date - subject to our availability
b) Any money paid (minus the 50% non refundable deposit) will be refunded back to your nominated account and the 50% deposit can be credited towards a future date (must be used within 12 months and subject to our mutual availability)
Cancellations with 1-5 days notice from your order date will receive no refund/credit as its it likely that your cake/order is in progress or is near completion.


*We retain the right to cancel the booking ourselves in very unusual circumstances beyond our control, such as ill health/family emergency/isolation, during which we will refund any money taken in full and attempt to organise another local cake decorator to provide the service subject to their availability

COVID LOCKDOWN CANCELLATIONS
If you need to postpone your event due to a snap Covid-19 LOCKDOWN, please get in contact with Be Caked as soon as possible to discuss your options. These will be assessed on a case by case basis however, in most instances, with a minimum of five (5) days notice, any money paid will be transferred to your new date (must be used within 12 months). In the event we do not have the availability for your new date then we will refund you any money paid (minus the initial non-refundable deposit and any expenses incurred - cake toppers, specialty items/ingredients that can’t be used on other cake future orders).

3.FINAL PAYMENTS
The balance of your order is due at least 5 days prior to the agreed collection/delivery date or your order may not fulfilled, and deposit will not be refunded - unless an arrangement has been made to pay cash on collection. If your booking date is less than 8 days from the time you book in your cake, the full amount is required. Wedding cake orders must be payed in full 2 week prior to the event date.

4. COLLECTION TIMES
Please arrive on time for your agreed pick up appointment. (This will be confirmed the week of your cake date, if not before). Whilst we do understand that things happen which can cause delays, we are a home run business and do schedule other collection appointments and activities around these pre-organised time. If you are running late, please let us know ASAP via our page messenger or texting us on 0421825630.

5. CHANGES
Any changes of size, style or flavours of the cake may incurred additional fees. Any changes requested after 1 week prior to the order date cannot be guaranteed and may be subject to additional charges.

6. DELIVERY/ SET UP
Delivery and setup fee is dependent on the location of the venue and will be stipulated in the final price. ALL WEDDING CAKES THAT ARE MULTI TIERED WILL REQUIRE TO BE DELIVERED BY US. (This ensures your cake arrives in tact, safely and stress free for all).

7. TRANSPORT OR YOUR ORDER
Please ensure you follow our instructions of how to transport and care for your cakes carefully. All our cakes come in cake boxes and travel the safest on the floor of the car (preferably the front passenger floor, or if needed, the back passenger floors are fine also). Please don’t place cakes on laps, car seats, or the boot of your cake. Please ensure the heater is not on during winter and the aircon is on in summer. Cakes must not be kept in the car any longer than necessary. Please ensure that when the cake is collected from us, it is then transported immediately to its required location (home, venue etc).

If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our possession. Due care must be taken when transporting cakes, and as a result we are not liable for any damage to cakes from transport once they leave our possession.

8. DAMAGE
We are not responsible for any damage to the cake after your cake is collected from us or setup is complete by us. You are responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 23 degrees Celsius or below. Keeping cakes out of the direct sun/heat/elements is also vital to the integrity of the cake.

9. If flowers or other decorations are provided by an outside source, we hold no liability for them. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.

10. On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.

11. Our products may contain or come into contact with milk, wheat, nuts, soy, gluten and other allergens. You agree to notify your guests of this risk and hold us harmless, not liable for allergic reactions.

12. Please be aware we are not a certified Gluten Free kitchen. Whilst every effort is made to clean our equipment thoroughly, trace elements of gluten may still be present. If you or your guests have coeliac disease, please make them aware of this potential risk.

 

13.CAKE CLASSES - CANCELLATIONS, REFUNDS AND CREDITS

In the event that a class is cancelled by Be Caked, a full refund will be provided. In the event of a no show, no refund or credit will be provided. If the student cancels their place in the class within 7 days of the class date, no refund or credit will be provide. If the student cancels their spot in the class prior to the 8-28 days before the class, a refund or credit will be issued. Credit must be used within 12 months of the class date. Class places can be transfer to another person - Please advise Beck of this prior to commencment of the class.

14. COMPLAINTS
We take great pride in all our cakes (both flavour and appearance) and aim to provide the best possible service we can. In the event you're unhappy with your order, please contact us ASAP so we can resolve the issue. Please avoid social media/internet reviews until we have had a chance to speak with you and resolve the issue.
All our cakes are sampled prior to completion for taste and photographed before collection to ensure we are providing you with our best product.  
We will always provide clear transport or storage instructions (either verbal or written) upon collection or delivery. If these are not adhered to, we can't guarantee the integrity of the cake once it leaves our possession.
Please be mindful of how a cake is stored if taken to a restaurant. Some cold rooms can dry out a cake. Fondant cakes are best kept at room temperature (away from heat, direct air conditioners) and buttercream cakes should be kept in a fridge (not a cold room) and removed at least 1-2 hours prior to being served so it comes back to room temperature for optimal serving/ taste.

If you are unhappy with your cake and are requesting a refund, we do require that cake be returned to us for inspection and a refund will be determined at Be Caked's discretion.  

15. EQUIPMENT
If your order requires equipment such as cake plates or a stand, a hire fee and a security deposit are required. The hire fee must be left with us at the time of the initial deposit in order to secure the equipment booking date and the security deposit payable with the final order payment. This ensures safe return of the equipment. In the event of cancellation, the security deposit will be refunded in full along with 50% of the hire fee.
Security Deposit: Your equipment security deposit will be refunded in full no later than two weeks (14 days) following the return of the equipment provided that the equipment is returned on time (within 3 days of the event), free of any damage (includes scratches) with any and all parts, accessories, and applicable hardware.
Return Policy: Failure to timely return your stand or other rentals (within 3 days of the event or an agreed date/time) will result in a full or partial forfeiture of your security deposit, which shall be left to the sole discretion of Be Caked

16. Performance of this agreement is contingent upon our ability to complete the Agreement and is subject to labor disputes or strikes, illness, accidents, Acts of God, and other causes beyond our control.

17. By placing an order with us and paying your deposit/retainer, you agree to the above terms and conditions.
